Rivers State Reacts to Court’s Suspension of Allocation Payments, Reveals Plan
The Federal High Court’s decision to prevent the Central Bank of Nigeria from disbursing monies to the state has been appealed by the Rivers State Government.
Due to problems with the state’s budget approval procedure, this court ruling suspended monthly allocations.
Recall that the Rivers State House of Assembly, led by Martin Amaewhule, a supporter of Federal Capital Territory (FCT) Minister Nyesom Wike, is engaged in a protracted conflict with Governor Siminalayi Fubara.
In the past, the political conflict has resulted in attempts to remove the governor from office.
Rivers State’s Commissioner for Information, Joseph Johnson, responded to the most recent ruling by telling reporters that the state is certain the appeal will reverse the decision. According to him, the government has already initiated action to appeal the court’s decision and was ready for this result.
“We anticipated this ruling when the trial judge denied 23 council chairmen joinders, denied the state a new attorney, and denied our challenge to the federal high court’s jurisdiction,” Johnson said.
“The judgment has already been appealed and l believe that the Court of Appeal will upturn the judgment. We are not panicked and there is no cause for alarm.”
The lawsuit started when Federal High Court Justice Joyce Abdulmalik determined that Governor Fubara had violated Nigeria’s Constitution by presenting the 2024 budget to just four members of the state House of Assembly.
Additionally, the judge referred to Fubara’s continuous use of public funds without complete consent as a “Constitutional violation.”
Additionally, Justice Abdulmalik decided that unless the budget is authorized by a duly elected House of Assembly, the Central Bank, Zenith Bank, and Access Bank should block Fubara from obtaining cash.
The suit brought by the Rivers House of Assembly and Martins Amaewhule against the CBN, Zenith Bank PLC, Access Bank PLC, Accountant-General of the Federation, Governor Fubara, Accountant-General of Rivers State, Rivers State Independent Electoral Commission, S. C. Amadi (Chief Judge of Rivers), Hon. Justice Adolphis Enebeli (retired), (Chairman, Rivers SIEC), and the Government of Rivers State, as first to tenth defendants, was followed by Justice Abdulmalik’s ruling.
The plaintiffs stated Governor Fubara has yet to comply with the court judgment that instructed him to re-present the 2024 Appropriation Bill to the Amaewhule-led faction of the Rivers State House of Assembly.
