Bayelsa Poll: Appeal Court Reverses Timipre Sylva’s Sack
The Court of Appeain Abuja, on Tuesday, reversed the verdict of the Federal High Court, which on October 9, disqualified the candidate of the All Progressives Congress, Timipre Sylva, from participating in the November 11 governorship election in Bayelsa State.
The lower court had decided in favor of APC member Demesuoyefa Kolomo, who argued that Sylva was not qualified to run for the governorship of Bayelsa State because she had been sworn in as the state’s governor twice before.
Sylva served as governor of Bayelsa from May 29, 2007 to April 15, 2008, again from May 27, 2008 to January 27, 2012, as Kolomo had mentioned.
On October 9, Justice Donatus Okorowo ruled in favor of Kolomo, disregarding Sylva from the election for governor.
Justice Okorowo declared that the drafters of the constitution specified that no one should be elected to office more than twice, citing the Supreme Court decision Marwa v. Nyako.
Sylva filed an appeal after being dissatisfied with the ruling and requested that the lower court’s decision be overturned.
A three-person panel of the Court of Appeal unanimously reversed the lower court’s decision on Tuesday, holding that Kolomo, the person who started the lawsuit, lacked the legal standing to do so.
The appellate court ordered N1 million in costs against Kolomo while reestablishing Sylva’s candidacy.
